1) Introduction

Welcome to ArchiGPT.ai (“ArchiGPT,” “we,” “us,” or “our”). ArchiGPT is operated by a company registered in England & Wales (Company No. 16031114). By accessing or using our website, apps, and services (collectively, the “Services”), you agree to be bound by these Terms & Conditions (the “Terms”). If you do not agree, do not use the Services.

2) Description of Service

ArchiGPT provides AI-powered tools for architects, interior designers, real estate professionals, and related fields, including chat-based ideation, image/scene editing, style transfer, and AI rendering features (the “AI Tools”).

ArchiGPT offers two access models:

  • Subscriptions: Eight auto-renewing plans — Basic, Pro, Premium, Ultra (each available Monthly or Annual).

  • Add-on Credits: A separate one-time purchase of extra credits you can use alongside any plan (or on their own where permitted).

Specific features, limits (e.g., render counts, rate limits, file sizes), and inclusions vary by plan and are shown at checkout or inside your account.

 

3) Eligibility & Accounts

a) Minimum age / authority. You must be able to enter a binding contract. If you register on behalf of an entity, you represent you are authorized to bind that entity.
b) Account security. You are responsible for maintaining the confidentiality of your login and for all activity under your account. Notify us immediately of any unauthorized use.
c) Accurate info. Provide true, current, and complete information and keep it updated.

 

4) User Obligations

a) Compliance. Use the Services only in accordance with these Terms and all applicable laws and regulations.
b) Rights to content you use. You must have all necessary rights (copyright, model/property releases, licenses, etc.) for any material you upload or prompt the AI Tools to process.
c) No prohibited content. Don’t use the Services to create, upload, or share unlawful, infringing, hateful, harassing, misleading, or otherwise harmful content; no attempts to generate or distribute illegal content or to violate anyone’s privacy.
d) Fair use. Do not bypass usage limits, rate limits, or security; do not scrape or automate access except via our expressly documented APIs (if any); no reverse engineering or competitive benchmarking that violates law or these Terms.

 

5) Public Display of User Inputs & Outputs

a) Default public use. By using ArchiGPT, you acknowledge and agree that all inputs and outputs you submit or generate (including images, prompts, seed values, text, and related metadata) may be published by us on public webpages (e.g., galleries, project/detail pages, feed items). These pages may be linked internally, included in our XML sitemaps, and otherwise made available in ways that enable discovery, crawling, and indexing by search engines (e.g., Google, Bing) and third-party archiving services.
b) Do not submit private data. Do not upload confidential or personal data you do not wish to be public. We are not responsible for safeguarding information you voluntarily submit in non-private areas.

 

6) Intellectual Property; Rights in Outputs

a) Our IP. The Services, software, models, interfaces, and all site content are owned by us or our licensors and are protected by IP laws.
b) Your uploads. You retain ownership of content you upload (“User Content”). You grant ArchiGPT a worldwide, non-exclusive, royalty-free license to host, process, display (including publicly where stated in §5), reproduce, and otherwise use User Content to provide and improve the Services.
c) Outputs. Subject to your compliance with these Terms and your lawful rights to the inputs, you may use the AI outputs for commercial and non-commercial purposes. You are responsible for ensuring that your use of outputs complies with applicable laws (including IP laws and any third-party rights in your inputs).
d) Attribution/training. We may use de-identified usage data and aggregated statistics to improve the Services. We will follow our Privacy Policy for any personal data.

 

7) Data Retention

a) Storage window. Renders, chats, and files may be stored for a limited 7 days unless otherwise stated in the interface; after that they may be deleted. You are responsible for downloading and backing up your work.
b) Operational display. As described in §5, some items may be displayed publicly. Avoid uploading anything you intend to keep private.

 

8) Plans, Billing & Add-on Credits

a) Auto-renewing subscriptions. Monthly plans renew each month and annual plans each year until you cancel. You can cancel anytime from your account settings and then through Stripe portal; cancellation prevents future renewal charges but does not refund the current period. You retain access until the end of the paid term.
b) Upgrades/Downgrades.

  • Plan changes (upgrade or downgrade). When you change plans, your current subscription ends immediately and a new subscription starts at once on the selected plan. We calculate a prorated refund for the unused portion of your current term (based on remaining time/credits in that period) and issue it per our Refund Policy; we may net this amount against the first charge of your new plan. All limits and features of the new plan apply immediately. Previously purchased add-on credits remain in your account and are consumed under the new plan’s rules. (This prorated treatment applies only to plan changes; standard cancellation of a plan without starting a new one remains non-refundable for the current term.)

c) Add-on credits. Credits are a one-time purchase, non-recurring, and non-transferable. They are consumed as you use eligible features. Any expiration or special conditions (if applicable) will be shown at checkout or in your account.
d) Pricing & taxes. Prices may change; any change for renewals will be communicated or shown before it takes effect. Taxes (e.g., VAT/GST) may be added as required by law.
e) Payment processors. We use third-party processors (e.g., Stripe) to collect payments. Their terms may apply.
f) Non-payment. If a charge fails, we may suspend or limit your access until payment is resolved.

9) No Professional Advice; AI Limitations

AI systems can produce inaccurate or incomplete information, and outputs may require review, editing, or professional judgment. ArchiGPT does not provide architectural, engineering, legal, or other professional advice. You are solely responsible for verifying fitness for your use case and for complying with codes, permits, and professional standards.

 

10) Service Changes & Availability

We may update, add, or remove features; impose or adjust limits; or suspend the Services (e.g., for maintenance, security, legal, or business reasons). We do not guarantee uninterrupted availability or error-free operation, and we may offer some features as beta or experimental.

 

11) Third-Party Content & Links

The Services may reference third-party sites, models, assets, or datasets. We do not control and are not responsible for third-party materials or their terms.

 

12) Indemnification

You agree to indemnify and hold harmless ArchiGPT, its officers, directors, employees, and agents from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to: (i) your use of the Services; (ii) your User Content or outputs; (iii) your breach of these Terms or applicable law; or (iv) any dispute between you and a third party.

 

13) Limitation of Liability

To the maximum extent permitted by law, ArchiGPT shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, data, or goodwill; or business interruption, even if advised of the possibility. Our aggregate liability for all claims relating to the Services shall not exceed the amount you paid to us for the Service in the three (3) months preceding the event giving rise to liability.

Some jurisdictions do not allow certain limitations; in those cases, the limitations apply to the fullest extent permitted.

 

14) Term & Termination

We may suspend or terminate your access immediately if you breach these Terms or if required by law. You may stop using the Services at any time. Upon termination, the licenses you granted survive only as necessary for us to meet legal obligations and to resolve disputes.

 

15) Changes to These Terms

We may modify these Terms from time to time. Updated Terms will be posted with a revised “Last Updated” date. Your continued use after changes become effective constitutes acceptance of the updated Terms.

 

16) Governing Law & Dispute Resolution

These Terms and any non-contractual obligations are governed by the laws of England and Wales. Courts in England shall have exclusive jurisdiction, without prejudice to any mandatory consumer rights you may have under local law.
